Divorce

Louisiana law allows for several types of divorce.

A party may file what is referred to in other jurisdictions as no “No Fault” divorce.  In Louisiana a divorce may be considered a “No Fault” divorce if the parties must have lived separate and apart for either six (6) months, if there are no minor children of the marriage, or one (1) year, if there are any minor children of the marriage.

Louisiana law provides for “Fault Based” divorce in the following situations:

  • adultery
  • a spouse being convicted of a felony and sentenced to death or imprisonment at hard labor
  • the spouse or a child of one of the spouses being physically or sexually abused by the other spouse
